Power Planet Terms and Conditions:

• Are subject to change without prior notice and you agree that once an order is placed it shall be subject to the terms and conditions in force at the time of order;
• Represent the entire agreement between the parties and no alterations or additions may be effected unless agreed to by both parties, all changes must be reduced to writing and signed by the client and a duly authorized representative of Powerplanet.co.za;
• Are final and binding and are not subject to any suspensive or dissolutive condition;
• Expressly exclude any conflicting conditions stipulated by you the buyer/client in any way;
• Are subject and apply to all employees, staff, resellers and agents of Powerplanet.co.za.

Estimates:

All quotes will remain valid for a period of 48 Hours or 2 calendar days from the date of issue due to currency fluctuations.

Payment Terms & Conditions

Powerplanet.co.za accepts the following payment methods:

• Credit Cards – Visa, MasterCard, Diners Club & American Express
• Debit Cards – ABSA, Standard Bank or Nedbank
• Electronic Funds Transfer
• Cash Deposits
• International Wire Transfers using our Swift Number: FIRNZAJJ

It is your responsibility to determine whether the goods ordered are suitable for the purpose of intended use. Should you be uncertain as to the application of a product, please contact our offices for assistance 087 2310 190 prior to placing your order.

No order will be official on Powerplanet.co.za until it has been accepted by management and Paid for in full.

Full Payment for product/s ordered is due prior to shipment.

You can make payment via EFT, or via any of the approved methods of payments referred to above.

Where applicable, prices are quoted on the ruling day exchange rate and may increase as a result of adverse changes in the exchange rate. Until such time as we have received payment in full, we reserve the right to charge any fluctuations to the client’s account and the client undertakes to pay for such fluctuations on demand. It is the responsibility of the client to check that there have been no changes in the price prior to making payment.

Credit Card Processing and Security

Credit card transactions will be processed for Powerplanet.co.za via Virtual Card Services who are the approved payment gateway. VCS uses strict form of encryption, named Secure Socket Layer 3 (SSL3) and no credit card details are stored on our website. Users may go to www.vcs.co.za to view their security certificate and security policy.

Shipping Cost

Your total cost for purchase of any product will include shipping and handling charges as reflected on the Powerplanet.co.za invoice. 

You undertake to effect payment as specified on the invoice furnished to you and acknowledge that Powerplanet.co.za will not process or ship your order until full payment is received.

Delivery Policy

Any delivery note or waybill (copy or original) signed by you or person accepting delivery on your behalf and held by Powerplanet.co.za shall be sufficient proof that delivery was made to you. Goods delivered must be checked in order to confirm that the goods delivered are in accordance with the order placed and are free from visible damage/defect. Any discrepancies and/or visible defects must be noted on the delivery note/waybill and you will have 7 days to return the item to us for the carry in warranty to be honored, at your own cost.

All orders will be dispatched as soon as full payment has been received and stock availability has been confirmed. Courier takes place over a period of 48 hours to 10 working days depending on your delivery adress and prior arrangements that needed to be made when the order was confirmed to ensure best practise and quality. International inport products may take anything from 5 to 10 weeks to arrive in South Africa but you will be notified before placing your order. Orders placed for inports cannot be refunded once the order is paid and placed as the ship cant turn around and inport products are specially ordered as per client request.

Powerplanet.co.za reserves the right to divide the delivery of goods ordered in the quantities and on the dates it decides with your prior consent, which consent shall not be unreasonably withheld. In the event that courier of freight services are delayed Powerplanet.co.za cannot be held liable. Minimum order quantities may affect shipping times.

Should you choose to engage a third party to transport the goods, you indemnify Powerplanet.co.za against any claims of whatsoever nature that may arise from such an agreement.

Powerplanet.co.za warrants that it will endeavor to meet delivery times, but shall not be liable for any loss or damage of whatsoever nature which you may suffer as a result of any delayed delivery, unless the aforesaid has regard to circumstances within its reasonable control.

Please note we will be closed from the 16th Decembers 24^th & 25^th Decembers and 1 Januaries – Product availability may be limited during this time.

Courier Services

Our Couriers will deliver to any valid South African address. You will be furnished with a tracking number when the goods have been dispatched.

Pricing

Price, specifications and terms are subject to change, you are therefore requested to peruse the prices, specification and terms prior to placing any order. The purchase price will be the current price as appearing on Powerplanet.co.za’s website www.powerplanet.co.za.

You hereby confirm that the goods and services on the Tax invoice issued duly represent the goods ordered by you at the prices agreed to by you.

If prior to delivery of the goods, there is any increase in the cost of the goods, or if any other taxes or duties are levied or any laws are promulgated which directly or indirectly increases the cost thereof to the company, the company shall be entitled to increase the price of the goods by an amount equal to such increased cost, by giving you reasonable notice thereof.

Variation of Orders

All orders and variations to orders are subject to these terms and conditions. Orders must be cancelled and reordered with the correct items before payment is made. If the order is placed, paid and ordered from our supplier it’s too late to change the order. Notwithstanding the above, Powerplanet.co.za may, at its sole discretion, elect to accept and act upon telephonic orders. Powerplanet.co.za however reserves the right to refuse delivery or collection of any order until placed in possession of a written order form.

Deposit and Cancellation of Orders

Requests for cancellation of an order, prior to delivery, must be submitted in writing to [email protected].

No refunds will however be furnished on deposits in the event of cancellation for specially ordered or manufactured goods that we don’t have stock of.

Any order is subject to cancellation by Powerplanet.co.za should the goods ordered become unavailable due to any cause beyond Powerplanet.co.za’s reasonable control but only if the manufacturer of the product agrees to refund the amount to Powerplanet.co.za

Processing Times

You can expect an order to be processed within approximately three to five business days, provided the items are in stock and the payment has been verified. Powerplanet.co.za therefore cannot guarantee same day shipping. Customers should also note that no orders will be processed on weekends and official public holidays. Imported items will take 15 - 32 days.

Back Orders

Powerplanet.co.za will notify you should there be any delay in obtaining/delivering any goods ordered. The unavailable order will be placed on back order, and the remainder of the order placed will be shipped. Please check our website for the back ordered items estimated time of arrival. Please note that the dates reflected are estimates and we cannot guarantee the arrival dates. Any order is subject to cancellation by us should the goods ordered become unavailable due to circumstances beyond our reasonable control.

Warranties

To the extent allowed by law, and notwithstanding any other provision of this agreement:

• any goods supplied by the company shall be subject to the manufacturing company’s warranty;
• the only entitlement you shall have in respect of those goods shall be to require Powerplanet.co.za to enforce such warranty against the manufacturer of those goods on your behalf and only if the item is returned to us on your expense as carry in warranty.

 The warranty shall immediately be rendered null and void in the event of any of the following:

• Failure to use the products in accordance with instructions and specifications provided by the Manufacturer;
• Should the product has been subjected to physical damage, abuse, misuse, alteration, neglect, tampering, improper maintenance, or has been serviced, repaired, installed by persons not possessing the necessary qualifications required to do so;
• The product is not returned with an invoice/verifiable method confirming proof of purchase.
• The product not being installed by a qualified and manufacturer approved installer or technician.

 

Returns

You may return goods in the following instances:

• within 7 (seven) days of date of the receipt of the goods if the transaction falls within the scope of Section 44 of the Electronic Communications and Transmissions Act. The aforementioned return policy excludes items contemplated in Section 42(2) of the aforementioned Act; or
• within the implied warranty period if the product is defective; or
• within 10 (ten) business days, if Powerplanet.co.za has made an error in delivery.

Notwithstanding the above, Powerplanet.co.za shall not be required to accept the return of any goods, unless defective within the warranty period, if at your direction of you the goods have been:

• partially or entirely disassembled;
• physically altered;
• permanently installed, affixed or attached;
• joined or added to or blended or combined or embedded within other goods or property.

Returns Procedure

Powerplanet.co.za will not accept the return of any product without prior authorization by Powerplanet.co.za management. Serial numbers and product markings must match that of the original ordered product.

Customers agree to use only reputable carriers capable of providing proof of delivery and insurance for the entire value of the shipment. You are required to bear the cost of shipping and insurance required for the return of the goods to us. We will not refund shipping charges, Customers agree that all returned products for credit, replacement or refund will be 100% complete, in a resalable condition, and will include the original packaging material, manuals, blank warranty cards, and other accessories provided by the manufacturer.

If any component of the returned product is missing, Powerplanet.co.za’s will refuse to accept the return.

Repairs

Repairs must be done by the customer in the event that it is necessary and the damage is not covered by the warranty.

Powerplanet.co.za shall not be liable for any loss or damage of whatsoever nature which you may suffer as a result of any unforeseen costs and/or delayed repairs.

Limitation of Liability

To the extent allowed by law, you agree that Powerplanet.co.za shall not be liable to you or any other person or entity whatsoever in respect of any loss or damage:

• caused by or arising from any fact or circumstance beyond the reasonable control of Powerplanet.co.za;
• which is consequential or incidental loss or damage; and/or
• of whatever nature and howsoever arising from or in connection with the supply of goods.

Service Address and Notices

For all purposes under this agreement including giving of any notice, the payment of any amount, the service of any process and for all other purposes arising from this agreement you hereby choose the service address set out on the quotation for the order of goods.

Title and Risk of Loss

Powerplanet.co.za can arrange for the shipment of the goods ordered by you, shipping point, at which stage title to the goods purchased and risk of loss passes to you upon delivery to the carrier.

We reserve a purchase money security interest in the goods until such time as all goods have been paid for in full. You agree to allow us to sign appropriate documents on your behalf to permit Powerplanet.co.za to protect its purchase money security interest.

Competitions

You may enter the online competitions hosted by our website if you are a natural persons over the age of 18 (eighteen) years and currently residing in South Africa (being a resident or citizen); but will be excluded from entering if you are a director, partner, employee, agent, service provider, and consultant of Powerplanet.co.za, the sponsor or affiliated to its subsidiaries and its holding company, if any, or if you are the spouse, life partner, parent, child, sibling, business partner and associate of such persons.

The prize and steps required to accept the offer/participate in the completion will be posted on the website www.Powerplanet.co.za or relevant social media pages, which will also reflect the entry period. Any entries received thereafter will not be considered for the competition draw.

The outcome of the competition is subject to the decision of the judge, whose decision is final and no negotiation will be entered into thereafter.

Powerplanet.co.za reserves the right to redistribute all unclaimed prizes if not claimed after 3 (three) months after being given away on the website. Prizes are not transferable and may not be exchanged for cash.

Powerplanet.co.za and their sponsors reserve the right to cancel, modify or amend the competition at any time if deemed necessary in their opinion, or if circumstances arise outside of their control.

By entering the competition, you agree to accept the competition rules and to be bound by them.
